Terms and conditions - Win free rail travel

Information on how to enter and prizes form part of these terms and conditions of entry, and entry into the competition is deemed acceptance of them.

The promoter is Rail Corporation of New South Wales (RailCorp), Level 6, 18 Lee Street, Chippendale NSW 2008. ACN 325 778 353 Phone (02) 8202 2000.

The promotion commences at 12.01 am AEST on 03/11/08 and continues until 11:59 pm AEST on 19/12/08 (Promotion Period).

Entry is open to all residents of New South Wales. Employees of RailCorp and their immediate families are ineligible to enter. Entry into the competition will constitute a representation of eligibility to enter.

To enter individuals must visit the website www.cityrail.info and subscribe to receive “CityRail Update” newsletters via email. (Subscribed individuals will have one, or more if specified of 7 different versions “CityRail Update” newsletters sent to their nominated email address by RailCorp at intervals to be determined by RailCorp, from time to time, in it’s absolute discretion).
Only 1 entry is permitted from any one unique email address.
All entries and the information contained therein remain the property of RailCorp.
RailCorp is not responsible for late, lost or misdirected entries sent but not received by RailCorp.
There will be one Prize draw at 10:00 am AEST on 22/12/08 at the RailCorp Communications Division Office at Level 6, 18 Lee Street Chippendale NSW 2008.
The first 20 valid entries drawn will win a RailCorp ‘FlexiPass’ valid for a period of 28 days for travel on CityRail services between any 2 stations on the City Rail Network (Value will not exceed RRP of $414.00).
RailCorp accepts no responsibility for any variation in the prize value between winners due to differences in nominated destination stations on FlexiPass prizes. Subject to the prize values above not being exceeded, winners may request any valid destination stations for their FlexiPasses. RailCorp also retains the absolute discretion to limit or otherwise determine the destinations for all FlexiPass prizes issued as a result of in this competition, for any reason. Prizes do not include any accommodation, transfers or any spending money.
The total value of the prize pool is RRP $8,280.00.
Winners will be notified by email to their nominated email address within 3 business days of the draw (Confirmation Email). It is the responsibility of each entrant to ensure the details provided in their entry are correct.
If a Confirmation Email is undeliverable for any reason including but not limited to an error in the destination email address as supplied by the entrant or any error in or action of an ISP or email provider (including filtering), but excluding any error or malfunction within the RailCorp email system, a second Confirmation Email will be sent to the winner. Should the second Confirmation Email also be undeliverable for any reason, excluding any error or malfunction within the RailCorp email system, that prize will be redrawn.
In order to claim their prize each winner must confirm their receipt of the confirmation email and acceptance of the prize no later than midnight 21 days after the date of the draw. If a winner fails to claim their prize within this time period they will forfeit their prize and it will be redrawn.
Winners must provide RailCorp with all the details it requires to issue prizes including but not limited to their personal details, proposed start date of their Flexipass and the stations they nominate as start and end points for their Flexipass.
The start date for all prizes must be less than 28 days after the date of the draw.
Each winner may choose the date of commencement of their CityRail FlexiPass, but this date must be no later than the date that is 3 calendar months after the date of the draw. Any prize not commenced by that date will commence on a date determined by RailCorp at its absolute discretion.
If a winner fails to provide all details required by RailCorp to issue their prize by midnight on the day 28 days after the date of the draw they will forfeit their prize.
Winners may be published on the CityRail website.
Subject to NSW law if a prize, in the opinion of RailCorp, can not be provided for any reason, then RailCorp reserves the right to provide an alternative prize of up to the same value as the prize being replaced.
Each prize must be taken as stated and no compensation will be payable if a winner is unable to utilise a prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize can not be transferred to any other person. Nominated stations can not be changed once a prize has been issued.
In the event that any entrant forfeits or does not claim a prize or is otherwise unable to comply with or satisfy these terms and conditions RailCorp reserves the right to conduct a redraw. This redraw will be held at 10:00 am AEST on 16/01/09 at the RailCorp Communications Division Office at Level 6, 18 Lee Street Chippendale NSW 2008.
To the extent permitted by law RailCorp, it’s officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained by any entrant, winner or any other party in connection with this promotion or the use of a prize.
RailCorp reserves the right to disqualify any entrant that tampers with the entry process. RailCorp is not responsible for any technical malfunctions or problems with internet, email or network congestion including injury or damage to any persons computer related to this promotion.
RailCorp has the absolute discretion to amend these terms and conditions, delete or introduce new terms and conditions to ensure the compliant and effective running of this promotion. RailCorp will, in its sole discretion, determine all questions or issues whatsoever (including without limitation, any matters of ambiguity, doubt, judgement or interpretation) that may arise in respect of this promotion. RailCorp’s decision will be final.
RailCorp may, without giving rise to any liability, terminate this promotion at any at any time without cause or providing notice of reasons.
